Foreignay Travel & Tours is committed to transparency and fairness in all transactions. This Refund Policy outlines the conditions governing cancellations, refunds, chargebacks, and fraud prevention.

ARTICLE I: PURPOSE

This Refund Policy establishes the terms and conditions governing the refund of payments made to Foreignay Travel and Tours ("the Agency") for travel-related products and services. It is intended to protect the interests of both the Agency and its clients while ensuring compliance with applicable laws of the Republic of the Philippines and the policies of third-party travel service providers.

ARTICLE II: APPLICABILITY

This Policy shall apply to all clients, passengers, travelers, representatives, corporations, organizations, and other persons who purchase, reserve, or avail of any travel product or service through Foreignay Travel and Tours.

This Policy shall form an integral part of every quotation, booking confirmation, invoice, itinerary, travel proposal, and service agreement issued by the Agency.

Payment of any amount shall constitute the client's full acceptance of this Policy.

ARTICLE III: NATURE OF THE AGENCY

Foreignay Travel and Tours acts solely as an intermediary and booking agent between the client and independent third-party suppliers, including but not limited to:

  • Airlines;

  • Hotels and accommodations;

  • Cruise lines;

  • Tour operators;

  • Transportation providers;

  • Visa processing centers;

  • Embassies and Consulates;

  • Travel insurance companies; and

  • Other travel-related service providers.

The Agency does not own, operate, manage, or control such suppliers and shall not be liable for their acts, omissions, cancellations, delays, schedule changes, insolvency, service deficiencies, or refund decisions.


ARTICLE IV: GENERAL REFUND PROVISIONS

Refunds shall be governed by the following principles:

  1. No refund shall be granted unless expressly permitted under the applicable policies of the concerned travel supplier.

  2. The Agency shall process refund requests only after receiving confirmation from the concerned supplier regarding refund eligibility.

  3. Refunds shall be limited only to amounts actually recovered by the Agency from the supplier after deducting applicable penalties, administrative charges, taxes, bank fees, and other lawful deductions.

  4. Approval of a refund request shall not create an obligation on the part of the Agency to advance, substitute, or guarantee funds pending supplier reimbursement.

ARTICLE V: NON-REFUNDABLE PAYMENTS

Unless otherwise required by law, the following payments are final and non-refundable upon payment or commencement of service:

  • Agency Service Fees;

  • Booking and Reservation Fees;

  • Consultation Fees;

  • Visa Assistance Fees;

  • Documentation and Processing Fees;

  • Courier and Delivery Charges;

  • Government Fees and Taxes already remitted;

  • Travel Insurance Premiums;

  • Payment Gateway Charges;

  • Bank Charges;

  • Credit Card Processing Fees; and

  • Other administrative expenses incurred by the Agency in connection with the booking.

ARTICLE VI: AIRLINE BOOKINGS

All airline tickets shall be subject exclusively to the fare rules and refund conditions imposed by the issuing airline.

Promotional, discounted, group, special, incentive, or seat-sale fares are generally non-refundable unless otherwise authorized by the airline.

Where refunds are permitted, the following may be deducted:

  • Airline cancellation penalties;

  • Fare differences;

  • Administrative charges;

  • Government taxes where non-refundable;

  • Airline processing fees; and

  • Other applicable charges imposed by the airline.

The Agency shall have no authority to alter or waive airline policies.

ARTICLE VII: LAND ARRANGEMENTS, TOURS, AND HOTEL BOOKINGS

Hotel accommodations, tour packages, transportation services, cruises, attraction tickets, event passes, and other land arrangements shall be governed by the cancellation and refund policies of the respective suppliers.

The Agency shall not be liable for any amount declared non-refundable by the supplier.

Unused services shall not automatically qualify for a refund.

ARTICLE VIII: VISA AND DOCUMENTATION SERVICES

Visa application assistance fees are non-refundable once documentation review, appointment scheduling, application preparation, or submission has commenced.

Embassy fees, visa center charges, courier fees, and government payments are likewise non-refundable except where expressly authorized by the issuing authority.

The Agency does not guarantee visa approval, and a visa refusal, denial, delay, or cancellation shall not entitle the client to a refund of agency fees or government charges already paid.

ARTICLE IX: CLIENT-INITIATED CANCELLATION

Where cancellation is initiated by the client, all cancellation penalties imposed by suppliers shall be borne solely by the client.

The Agency reserves the right to deduct all applicable charges prior to releasing any approved refund.

ARTICLE X: NO-SHOW

Failure of the client to:

  • Check in for a flight;

  • Arrive at the hotel;

  • Participate in a scheduled tour;

  • Present required travel documents; or

  • Utilize the booked travel service,

    without prior notice or valid justification, shall constitute a NO-SHOW.

    No-show bookings are generally considered forfeited and non-refundable, subject to supplier policies.

ARTICLE XI: FORCE MAJEURE

The Agency shall not be liable for failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to:

  • Natural disasters;

  • Typhoons;

  • Earthquakes;

  • Floods;

  • Volcanic eruptions;

  • Fires;

  • Pandemics or epidemics;

  • Government regulations or travel restrictions;

  • Border closures;

  • Political unrest;

  • War;

  • Terrorism;

  • Civil disturbances;

  • Airline suspension of operations;

  • Airport closure;

  • Supplier insolvency; or

  • Other events constituting force majeure under Philippine law.

Any refund arising from such events shall depend entirely upon the policies of the affected supplier.

ARTICLE XII: REFUND PROCEDURE

All refund requests shall:

  1. Be submitted in writing through the Agency's official communication channels;

  2. Include the client's complete name, booking reference number, valid government-issued identification, and reason for the request; and

  3. Be accompanied by all supporting documents required by the supplier or the Agency.

Incomplete submissions may be held in abeyance until all required documents have been received.

ARTICLE XIII: PROCESSING PERIOD

Refund processing shall commence only after:

  1. Complete documentary requirements have been submitted;

  2. Refund approval has been received from the concerned supplier; and

  3. The Agency has received the refundable amount from the supplier, where applicable.

Processing periods may vary depending on the supplier's internal procedures and financial institutions.

The Agency shall not be responsible for delays beyond its reasonable control.

ARTICLE XIV: MODE OF REFUND

Approved refunds shall be released through any of the following methods, at the Agency's discretion or by agreement with the client:

  • Original mode of payment;

  • Bank transfer;

  • Electronic wallet (e.g., GCash or Maya);

  • Company check; or

  • Travel credit or voucher, upon mutual agreement.

ARTICLE XV: LIMITATION OF LIABILITY

The Agency's liability shall, in all cases, be limited to the amount actually recovered from the concerned supplier after lawful deductions.

The Agency shall not be liable for consequential, incidental, indirect, special, exemplary, or punitive damages arising from cancellations, delays, supplier default, denied boarding, visa refusal, or any other circumstance beyond its control.

Nothing in this Policy shall be construed to waive or diminish any rights that consumers may have under applicable Philippine laws.

ARTICLE XVI: GOVERNING LAW

This Refund Policy shall be governed by and construed in accordance with the laws of the Republic of the Philippines, including, where applicable:

  • Republic Act No. 7394 (Consumer Act of the Philippines);

  • Republic Act No. 9593 (Tourism Act of 2009);

  • Republic Act No. 386 (Civil Code of the Philippines);

  • Republic Act No. 10173 (Data Privacy Act of 2012), where applicable;

  • Rules and regulations issued by the Department of Tourism (DOT), Department of Trade and Industry (DTI), Civil Aeronautics Board (CAB), and other competent government agencies.

ARTICLE XVII: DISPUTE RESOLUTION

The parties shall endeavor to resolve any dispute amicably through good-faith negotiations.

Should amicable settlement fail, either party may seek appropriate remedies before the proper government agency, tribunal, or court having jurisdiction under Philippine law.

ARTICLE XVIII: AMENDMENTS

Foreignay Travel and Tours reserves the right to amend, modify, or update this Refund Policy at any time to comply with changes in law, governmental regulations, supplier policies, or operational requirements.

The version in effect on the date of booking shall govern the transaction unless a later amendment is required by law.

CLIENT'S ACKNOWLEDGMENT AND CONSENT

By signing a booking confirmation, accepting a quotation, making a reservation, paying any amount, or otherwise availing of any service from Foreignay Travel and Tours, the Client acknowledges that he/she has read, understood, and voluntarily agreed to be legally bound by the terms and conditions of this Refund Policy.
